1. Purpose of This Agreement

The purpose of this Agreement is to exclude the liability of the Released Parties to the extent permissible by law to pay damages or any other form of compensation for any personal injury or death suffered by me resulting from participating in the Recreational Activity.

2. Acknowledgement of Risk

I acknowledge that the Recreational Activity involves the risk of serious injury, physical harm or death. I understand that motocross is a high-risk activity and hazards include but are not limited to: falls, collisions with other riders or track infrastructure, mechanical failure, constructed jumps, tabletops, berms, rhythm sections and other purpose-built obstacles, uneven terrain, and actions of other participants. I confirm that I have inspected the track and am satisfied it is suitable for my skill level prior to riding. I acknowledge that I am voluntarily assuming all risks associated with the Recreational Activity with full knowledge of those risks (Volenti non fit injuria).

3. Voluntary Participation

I acknowledge that in signing this Agreement I have done so voluntarily and that no pressure or unfair tactics have been used to persuade me to sign, and that I have done so in the knowledge that it is open to me not to sign and to elect not to participate.

4. Release of Liability — Personal Injury and Death Only

I release and forever hold harmless the Released Parties from and against any claims, actions, suits, proceedings or liabilities of any kind in respect of any personal injury or death suffered by me arising from or in connection with my participation in the Recreational Activity or my presence on the property.

5. Indemnity — Personal Injury and Death Only

I agree to indemnify the Released Parties against any claims, actions, suits, proceedings or liabilities in respect of any personal injury or death suffered by me or any person for whom I am responsible arising from or in connection with my participation in the Recreational Activity or my presence on the property.

6. Statutory Consumer Guarantees Waiver

I agree that the liability of the Released Parties for any personal injury or death resulting from the supply of Recreational Services is excluded to the fullest extent permitted by law, including pursuant to section 139A of the Competition and Consumer Act 2010 (Cth). I acknowledge that I am voluntarily assuming all risks associated with the Recreational Activity with full knowledge of those risks.

7. Property Damage, Theft and Financial Loss

I agree that the Released Parties accept no liability for any theft, loss or damage to motorcycles, riding gear, vehicles or any other personal property brought onto the premises, howsoever caused. This clause is separate and independent from the personal injury and death exclusions in Clauses 4, 5 and 6 above.

8. Park Rules — I Agree to Abide By These at All Times

1. All riders must sign in with the track operator upon arrival. A coloured session sticker will be issued and must be displayed on the rider's bike at all times while on the property.
2. Approved helmet (AS/NZS 1698 or equivalent), boots, gloves, goggles and appropriate protective gear must be worn at all times on track.
3. Riders must obey all flag signals, marshal instructions and track signage at all times.
4. No riding under the influence of alcohol or drugs.
5. Riders must maintain control of their bike and ride at a speed appropriate to conditions.
6. Junior riders (under 18) must have this waiver signed by a parent or legal guardian before riding. The parent or guardian must be present on site for the entire session.
7. Bikes must be in a safe and roadworthy condition with functioning brakes.
8. No spectators or non-riders on the track at any time.
9. The Provider reserves the right to remove any rider for unsafe, reckless or antisocial behaviour without refund.
10. All riders must comply with track-specific rules briefed on arrival.

9. Health Declaration

I declare that I am in good physical health and am not aware of any medical condition, disability or impairment that would make it unsafe for me to participate in the Recreational Activity. I understand it is my responsibility to seek medical advice if I am unsure.

11. Parent / Guardian Deed of Indemnity — Riders Under 18

In consideration of the Released Parties allowing the minor Participant to ride, I agree as parent or legal guardian to indemnify and hold harmless the Released Parties against any and all claims, actions, costs and damages brought by or on behalf of the minor Participant arising from their participation in the Recreational Activity or their presence on the property. I acknowledge that this indemnity is given with full knowledge that the minor's right to bring a claim is not extinguished by this Agreement, and I accept personal financial responsibility for any such claim. I further warrant that I have informed the Participant that the Recreational Activity involves the risk of serious injury, physical harm or death, and I confirm I have read and agreed to the Park Rules on the Participant's behalf.

12. Participant Declaration

I confirm that I have read and understood this Agreement in its entirety, that I am 18 years of age or older (or that the Parent/Guardian Deed of Indemnity above has been completed by my parent or legal guardian), and that I agree to be bound by its terms.
